This Privacy Policy describes how iKonX App LLC ("iKonX", "we", "our", "us"), a subsidiary of ViZion Protocol Entertainment LLC, collects, uses, shares, and protects your personal information when you use the iKonX mobile application ("the App").

1. Information We Collect

1.2 Information Collected Automatically

• Device Information: Device model, operating system version, unique device identifiers.

• Push Notification Tokens: Device tokens for delivering notifications (with your permission).

1.3 Information from Third Parties

• Apple: Subscription status, purchase receipts (via Apple In-App Purchases).
• Stripe: Payment verification, account status, payout details.
• Subscription management services: Subscription data, entitlement status.

2. How We Use Your Information

We use the information we collect to:

• Operate the App: Create and maintain your account, process transactions, facilitate messaging and bookings.
• Process Payments: Charge buyers, credit artist wallets, process withdrawals through Stripe.
• Manage Subscriptions: Verify membership status, manage entitlements through RevenueCat and Apple.
• Communicate: Send transactional notifications (booking updates, payment confirmations), respond to support requests.
• Improve the App: Analyze usage patterns, diagnose technical issues, develop new features.
• Ensure Safety: Detect and prevent fraud, enforce our Terms of Service and Community Guidelines, moderate content.
• Legal Compliance: Comply with applicable laws, respond to legal requests, enforce our rights.

We do not use your information for targeted advertising. We do not sell your personal information to third parties.

3. How We Share Your Information

We share your information only in the following limited circumstances:

Your public profile information (name, photo, bio, genre, city, reviews) is visible to other iKonX users. Messages are visible only to conversation participants.

3.3 Legal Requirements

We may disclose your information if required by law, subpoena, court order, or government request, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.

3.4 Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.

4. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services. Specifically:

• Account Data: Retained until you delete your account.
• Transaction Records: Retained for a minimum of 7 years for tax and legal compliance.
• Messages: Retained until you delete your account or the conversation.
• Uploaded Content: Retained until you delete it or your account.
• Log Data: Retained for up to 90 days for security and debugging purposes.

When you delete your account, we will delete or anonymize your personal data within 30 days, except where retention is required by law.

5. Data Security

We implement industry-standard security measures to protect your data:

• Encryption in Transit: All data transmitted between the App and our servers is encrypted using TLS (Transport Layer Security).
• Encryption at Rest: Database and file storage are encrypted at rest.
• Access Restriction: Our database enforces strict per-user access controls and security policies ensuring users can only access their own data. All policies have been audited and verified.
• Authentication: Secure multi-layer authentication with token verification protects all account access.
• Payment Security: All payment data is handled by our certified payment processor. We never store credit card numbers on our servers.
• Access Controls: Administrative access is restricted and monitored.

While we strive to protect your information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security.

6. Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal information:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate or incomplete data.
• Deletion: Request deletion of your personal data (subject to legal retention requirements).

You may also delete your account directly through the App: Settings > Account > Delete Account.

7. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

• Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the sources, the business purposes, and the categories of third parties with whom we share it.
• Right to Delete: You may request deletion of your personal information, subject to certain exceptions.
• Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.
• Right to Opt-Out of Sale: We do not sell personal information. No opt-out is necessary.

To submit a CCPA request, email support@ikonx.app with the subject line "CCPA Request." We will verify your identity before processing.

In the preceding 12 months, we have collected the categories of information described in Section 1. We have not sold any personal information.

8. European Users — GDPR Rights

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, additional rights apply to you under the General Data Protection Regulation (GDPR) and applicable data protection laws.

• Contract Performance: Processing necessary to fulfill our Terms of Service and provide you the App.

iKonX is based in the United States. If you are located in the EEA or UK, your personal data will be transferred to and processed in the United States. We ensure appropriate safeguards are in place to protect your data in accordance with this Privacy Policy and applicable law.

How to Exercise Your GDPR Rights

To exercise any of your GDPR rights, contact us at support@ikonx.app. We will respond within 30 days. If you believe we have not adequately addressed your concerns, you have the right to lodge a complaint with your local data protection authority (DPA).

9. Children's Privacy

iKonX is not intended for users under the age of 18. We do not knowingly collect personal information from anyone under 18 years of age. If we become aware that we have inadvertently collected data from a minor, we will promptly delete that information.
